What financial settlement should I expect at the end of a marriage or de-facto relationship ?

When couples break up, they generally need to divide their finances.

In many cases this will be hard because parties sometimes cannot agree on what is fair for each to retain from the relationship.

This is one of the reasons why we have the Family Court, which acts as an umpire to decide what is just and equitable for people to retain.

 

What you can expect to keep after a relationship breakdown will depend on many things, including your income, age, health, and caring role for young children.

 

In some cases you may receive nothing. This is because the Court may rule that you should not be entitled to retain anything, because of your behaviour during the marriage. For example you may have gambled excessively. Or you may have spent money wantonly and without proper reasons.

In recent years there have been Court judgements where parties to relationships have received nothing at the end of a marriage.
